The Board’s job is to perform timely and consistent enforcement of the Association’s deed restrictions to avoid selective enforcement and waiver issues. We assist the Board and property management team to develop efficient violation and fining policies, and to effectively enforce them. While litigation may eventually be required, our goal is to provide practical and cost-effective conflict resolution when possible. We do this by ensuring the Board is fully apprised of all of its enforcement options, including self help.
Sometimes the deed restrictions themselves no longer truly reflect the Association’s needs. We help the Board determine when amendments are necessary, and then work with you to get them passed. Document amendment projects can be time consuming and costly, so we want to make sure you find success when you commit the effort. We do this by offering best practices and communication strategies aimed at increasing owner participation in the voting process. We also work with older communities to preserve or revitalize deed restrictions under the Marketable Record Title Act.
